Terms of Service

These Terms of Service (“Terms”) govern your access to iepprogress.org, our blog, and the IEP Assistant web application at app.iepprogress.org (collectively, the “Service”) operated by IEP Progress (“we,” “us”). By using the Service, you agree to these Terms and our Privacy Policy.

Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. The Service is for educators and other adults supporting special education workflows—not for student use.

Accounts

You are responsible for your account credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.

Acceptable use

You agree not to:

• Upload full student names, photos, or other information you are not permitted to share with us.
• Use the Service in violation of FERPA, IDEA, district policy, or other applicable law.
• Attempt to probe, scrape, or disrupt the Service or other users’ accounts.
• Reverse engineer or resell the Service except as allowed by law.
• Use generated text as a final legal or compliance document without your own professional review.

Your content

You retain ownership of notes and other content you submit. You grant us a limited license to host, process, and display that content solely to operate the Service (including sending it to our AI provider to generate drafts).

You represent that you have the rights to submit content and that your use complies with district and legal requirements.

AI-generated drafts

Narratives produced by the Service are drafts. You must review, edit, and approve every output before entering it into your LEA’s IEP system or sharing it with parents or colleagues. We do not guarantee accuracy, compliance, or suitability for any particular district form.

Plans and payment

Free and paid plans are described on our pricing page. Paid subscriptions renew according to the billing interval you select until you cancel. Refunds are handled as stated at checkout and on the marketing site (including our 30-day refund commitment where advertised). Taxes may apply.

Third-party services

The Service may link to district systems, payment processors, analytics, advertising, and AI providers. Their terms and privacy practices apply to those interactions.

Intellectual property

We own the Service, branding, and site content except for your submissions and third-party materials. You may not copy or misuse our trademarks without permission.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.

Indemnity

You will defend and indemnify us against claims arising from your content, your use of the Service, or your violation of these Terms or applicable law.

Suspension and termination

You may stop using the Service at any time and may delete your account in app settings. We may suspend or terminate access if you breach these Terms or if we must do so to protect the Service or others.

Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply.

Changes

We may update these Terms. We will post the revised Terms on this page with an updated date. Material changes may also be communicated by email or in-app notice where appropriate.
